Where is Novak's indictment?

Columnist Robert Novak went public and revealed CIA operative Valerie Plame Wilson, which is in violation of the Intelligence Identities Protection Act. How he got the information is an issue. However, is he immune from the law? Why isn't he indicted or in jail now?
